Texas Insurance Code Chapter 1952, Subchapter G governs how insurers may and may not influence the repair of a damaged motor vehicle. The four sections of the Texas Insurance Code that say otherwise, in plain language, with the complaint route if somebody ignores them. Six things worth knowing before you order
- Section 1952.301 says an insurer may not limit your coverage by specifying the brand, type, kind, age, vendor, supplier or condition of the parts used to repair your vehicle.
- The same section says an insurer may not stop you choosing your own repair person or facility, and applies that to third party claimants as well as policyholders.
- Section 1952.302 says an adjuster may not tell you, orally or in writing, that you must use a specific shop or one from a preferred list for the repair to be covered.
- Section 1952.302 also bars referral fees and gratuities in exchange for steering you to a shop, and bars making you travel an unreasonable distance to get the work done.
- Section 1952.304 says the insurer may not stop a shop telling you the description, manufacturer and source of the parts used, and what was charged for them.
- Section 1952.305 says the insurer or adjuster has to give you notice of these rights at the time the vehicle is presented for a damage claim. Most people never receive it.

Can my insurance company make me use aftermarket parts in Texas?
Texas Insurance Code Section 1952.301 prohibits an insurer from limiting policy coverage by specifying the brand, type, kind, age, vendor, supplier or condition of parts used to repair your vehicle.
Can an adjuster tell me which body shop to use?
No. Section 1952.302 prohibits an insurer, adjuster or their employer from stating or suggesting that you must use a specific repair facility or one from a preferred list for the repair to be covered.
Am I entitled to know what parts were used on my car?
Yes. Section 1952.304 prohibits an insurer from stopping a repair facility telling you the description, manufacturer and source of every part used and the amount charged for it.

What can I do if an insurer ignores these rules?
Section 1952.306 lets a policyholder, a third party claimant or a repair facility file a written, documented complaint with the Texas Department of Insurance about a violation of this subchapter.
Do these rights apply if the other driver's insurer is paying?
Yes. Section 1952.301 applies the same restriction to an insurer settling a third party property damage claim, so the at-fault driver's insurer cannot dictate your parts or your shop either.
How do I check that a used parts seller is licensed?
Texas licenses used automotive parts recyclers through the Texas Department of Licensing and Regulation under Occupations Code Chapter 2309, licences run one year and cover one facility, and TDLR inspects each facility at least once every four years.
